Parking Concepts, Inc. (“PCI”) is committed to protecting your privacy. This Privacy Policy (“Privacy Policy”) is applicable to everyone who uses PCI services, including but not limited to the PCI’s digital application known as Breeze, PCI’s website and PCI services performed as a part of the application or website (the “Service(s)”). This Privacy Policy deals with the method, purpose, protection, disclosure and use of personal information collected by PCI before, during, and after your use of the Services. When we refer to “we,” “us,” or “our,” we mean PCI or the specific division, subsidiary, or affiliate that provides the Services, each as appropriate and applicable.

When we refer to “you” or “your,” we mean the person using PCI Services. If the person accessing the Service acts on behalf of, or for the purposes of, another person, including a business or other organization, “you” or “your” also means that other person, including a business organization.

If any word or phrase has been defined within the PCI Terms and Conditions, but has not been defined within this Privacy Policy, that word / phrase will have the meaning that has been assigned to it in the PCI Terms and Conditions.

This Privacy Policy is broken up into four parts:

What is Personal Information?

What Do We Mean By “Personal Information” and “Personal Data”?

“Personal information” or “personal data” is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. Personal information that is publicly available, a matter of public concern (such as newsworthy information), aggregated (e.g., compiled to create statistics that cannot identify a particular individual) or de-identified (stripped of all unique identifiers such that it cannot be linked to a particular individual) is not considered “personal information” for the purposes of this Privacy Policy.

Sensitive Personal Information

Unless specifically requested, we ask that you not send us and you should not disclose, on or through the Services or otherwise to us, any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion, ideological or other beliefs, health, biometrics or genetic characteristics, national identification numbers, social security numbers, criminal background, trade union membership, or administrative or criminal proceedings and sanctions).

How Does PCI Get Your Information?

We may collect or process various categories of personal information. The section titled “What Type of Personal Information Do We Collect?” contains information on the categories of personal information collected. As an overview, depending on how you interact with us, we may collect personal identifiers, commercial information, and sensitive personal information. We collect this information to provide, maintain, and improve our Services, and for other reasons listed in the “How Is Personal Information Used?” section below. Your personal information may be disclosed to service providers or other third parties as outlined in “Who Do We Share Personal Information With?” We will retain your personal information for the period necessary to fulfil the purposes outlined in this Privacy Policy or as required by law. We do not sell your personal information for monetary compensation, nor do we partner with third-party advertising and analytics partners, which may be considered a “sale” of personal information under applicable laws. We only collect sensitive personal information, such as financial information, to complete a transaction, and we delete this information in accordance with our data retention practices. What Type of Personal Information Do We Collect?

We may collect the following information from you:

  • Information you provide to us as a part of the Services;
  • Information you provide to us on our ‘Contact Us’ webpage;
  • Information you provide in the course of communication with our staff via email, phone calls, or otherwise;
  • Information collected by way of cameras; and
  • Financial information you provide to us such as bank account details.

This information may include your name, phone number, vehicle information, license plate number, email address, country and any other personal information that you provide to us.

PCI does not collect any personal information without your explicit consent.

When you apply for a job with us, we may collect identifiers, professional or employment-related information, and education information from you via our job postings and otherwise, including:

  • Information you provide in connection with your application;
  • Information about you that is publicly available;
  • Health information, including disability information;
  • Information that you authorize us to collect via third parties, including former employers or references; and
  • Any other information provided in connection with your application.

We use your personal information to assess your skills in relation to the applicable job requirements. We may also use your personal information to contact you during the hiring process. In certain circumstances, you may submit your application for employment through a third-party service that displays our job posting. We do not control the privacy practices of these third-party services. Please review their privacy policies carefully prior to submitting your application materials.

Cookie Notice

When you visit our website/apps, PCI places certain cookies on your device that are necessary for the provision of the service. We may collect certain information about your online activity including among other things, number of guest visits, number of user visits, frequency of visits and total number of visitors to the website and specific pages.

Some of these cookies are necessary, and do things like keeping you logged in, adding functionality (like automated chat bots for customer service), or keeping the website and services safe from malicious attacks.

Other cookies help us carry out statistical analysis of page use, page interactions and how you interact with our websites to help us evaluate and develop our websites further. This helps us understand individual behaviors and needs, and how to revise and improve our websites and services.

The parties with whom we work, including Tawk.to (which helps us answer your questions via a chatbot) and Google (which helps us through Google Analytics and YouTube), may place, view, and/or use “cookies”, web server logs, web beacons, or mapping pixel/ pixel tag or other electronic tools to collect information about your use of the Service.

For example, Google Analytics places cookies on our website to help us carry out statistical analysis of page use, page interactions and how you interact with our websites to help us evaluate and develop our websites further. This information helps us understand individual behaviors and needs.

In comparison, for embedded YouTube videos, Google places a cookie on our website to carry over your viewing preferences from YouTube when you view content through the embedded videos on our services.

How is Your Information Used?

The personal information collected from you is used for specific purposes only and only for purposes pertaining to the Services. The personal information collected from you shall be used to improve customer service and support services, to personalize users’ experience, to improve the Services, to process payments or refunds, to send regular e-mails, to conduct contests, surveys, promotions, or for any additional purpose specified at the time of collection of the information. The information collected may be used for any purpose necessary to provide the Services.

Your personal information will be kept confidential and will not be used for any other purpose except as clearly specified in this Privacy Policy. We may disclose some or all of your personal information to third parties in case of a corporate divestiture or dissolution, or if required by law.

To communicate with our customers, combat fraud, identify you, help you keep a record of your interactions with us, help the Service remember you and your reservations; fulfill the purposes of the Service, complete transactions with our customers, improve your customer experience, and better develop the Service and our offerings.
Internet or other similar network activity. Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement. From the cookies on our websites and online portals, and Tracking Tools defined below. To fulfill certain purposes of the Service (i.e. remembering your login information), combat fraud, marketing to you informing you of our services and offers, providing you targeted advertising, running promotions, provide you information about PCI and its offerings, complete transactions with our customers, improve your customer experience and better develop the Service and our offerings.
Geolocation data. Physical location or movements. This is collected when you visit one of our facilities or from your phone when you use our services to determine the closest facility to you. This is only recorded to identify which of our facilities you have parked at and to show you nearby facilities.
Sensory data. Audio, electronic, visual information This is collected when you visit one of our facilities to the extent that such facilities are monitored by security cameras. This is recorded to ensure the safety of our parking facilities.
Sensitive Personal Account Information Anything that reveals your account log-In, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account From you, when you create an account with us or make a payment through our system. To communicate with you, fulfill the purposes of the Service and combat fraud

Disclaimer Regarding Video Content

The Services may contain video content, audiovisual content, or content of a like nature (collectively, “Video Content”). In connection with our provision of Video Content, the Services may utilize online tracking technologies and code-based tools, including, but not limited to, Software Development Kits (“SDKs”) and cookies (i.e., advertising or analytics cookies) that track information about your activity and webpage-viewing history on the Services (collectively, “Tracking Tools”). Tracking Tools on the Services may result in information about your activity on the Services being transmitted from your browser to PCI and third parties, which, in turn, may result in the display of targeted advertisements on third-party websites and platforms, including advertisements for PCI content. In addition, whether Tracking Tools on the Services results in your browser’s transmission of information to third parties depends on a number of factors that may be outside of PCI’s knowledge or control, including what third-party websites you use, what information you have provided to such third parties, and whether (and the extent to which) you have limited the use of cookies by the operators of those third-party websites.

Who Do We Share Personal Information With?

Except as provided in this Privacy Policy, your personal information will not be sold, traded, rented or shared with any other legal entity for any purpose except:

  • transferred to third-party service providers who help us facilitate our business activities or the Services;
  • shared with third parties in case of a merger or acquisition of PCI;
  • provided to service providers that facilitate contacting you;
  • provided to service providers that facilitate storing data; and
  • legal disclosures.

Any personal information provided to service providers or other third parties is provided to perform specific tasks and these parties are obligated by contract not to disclose or use the personal information for any other purpose.

We withhold the right to divulge your personal information as required by applicable federal, state, or local law, in reply to legal requests by public authorities, including meeting national security or law enforcement requirements and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or other legal process served on us.

Notwithstanding the above, PCI does disclose some of your information to third parties within the last twelve months as detailed below:

This is shared with the providers for our Tracking Tools, like Google for embedded YouTube videos. To market to you our services and offers, providing you targeted advertising, running promotions, improving your customer experience and better developingthe Service and our offerings.
Sensory data. Audio, electronic, visual information This is occasionally shared with the landlords for our facilities, who own the security camera systems, as well as any vendors hired to review security camera footage. This is shared to ensure the safety of our parking facilities.

Testimonials

Among the information we may retain/share with others are your testimonials that you publish through the Services, or share with us through external websites. You hereby grant, a non-exclusive, perpetual license to us to publish your comments / reviews / testimonials on our Services. Please note that such comments / reviews / testimonials may contain certain personal information. If you wish to have a comment/review/testimonial removed after publication, please contact us pursuant to our contact us information below.

How is Your Information Stored?

Data Storage and Retention

PCI is a California corporation. We will retain personal information for the period necessary to fulfil the purposes outlined in this Privacy Policy or as required by law.

The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide the Services to you (for example, for as long as you keep using our Services);
  • Whether you would reasonably expect us to retain your data until you ask us to delete it;
  • Whether there is a legal obligation to which we are subject (for example, certain laws may require us to keep records of your transactions for a certain period of time before we can delete them); and
  • Whether retention is advisable considering our legal position (for example, for statutes of limitations, legal disputes, or regulatory investigations).

Security

As the first line of defense against unwanted intrusions against your personal information, we limit the collection of your personal information as described in the Privacy Policy. We utilize reasonable and appropriate protections and procedural safeguards to ensure that personal information in our care is not misused or accessed without authorization. We restrict access to personal information to PCI employees, contractors, and agents who need to know that information in order to operate, develop, or improve our Services. Personal information is stored on the platforms of our service providers with access restricted to those employees or contractors who have a need for such access to perform a legitimate business function relating to our services, for maintenance and/or related issues.

Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure due to the inherent risks of data transmission over the Internet. Consequently, we cannot ensure or warrant the security of any information you transmit to us, and you understand that any information that you transfer to us is done at your own risk. If we learn of a security system breach, we may attempt to notify you, including electronically, so that you can take appropriate protective steps. By using the Services or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Services. We may post a notice via our Services if a security breach occurs. We may also send an email or postal mail to you at the email address you have provided to us in these circumstances. Your Privacy Rights

Data Transfers

The Services are hosted in the United States. In order to communicate with you about content, the information that we collect from you may be transferred to, stored, used, and processed by PCI in the United States or one of our service providers based in the United States or outside of the United States. Such entities may be engaged in, among other things: (i) preparing and sending newsletters to which you subscribe; (ii) the processing of payment details; and (iii) the provision of support services.

If you are visiting from the European Union or other regions with laws governing information collection and use that may differ from United States law, please note that you are transferring your personal information to the United States. The laws of some countries may not provide the same levels of protection of personal information as your home country, particularly if you are resident in the European Union. By using the Services, you agree to the collection, transfer, storage, use and processing of information about you for the purposes described in this Privacy Policy. When you provide personal information to us or our service providers or vendors, you consent to the processing of your information in the United States as the Services are operated in the United States. Policy Regarding Children’s Personal Data

The Services are not directed to children under the age of 18. We do not knowingly collect personal information from children under 18. If you are under 18, please do not use the Services and do not provide any personal information to us.   • Third Parties. We obtain Personal Data about you from third parties, such as outbound marketing vendors and others. This information may include outbound marketing lists and other similar information.

  • Cookies. We collect Personal Data via cookies and similar technologies.

2. How We Use Personal Data About EU Residents

We use the Personal Data we collect for the following purposes:

  • Providing the Services, including to operate, maintain, support, and provide our Services.
  • Communicating with You, including to contact you for administrative purposes (e.g., to provide services and information that you request or to respond to comments and questions) or to send you marketing communications, including updates on promotions and events, relating to products and services offered by us.

We rely on a legal basis to process your Personal Data, including:

  • Consent. You have consented to the use of your Personal Data, for example to send you electronic marketing communications or for the use of certain cookies.
  • Contract. We need your Personal Data to provide you with our Services and to respond to your inquiries.
  • Legal Obligation. We have a legal obligation to use your Personal Data, for example to comply with tax and accounting obligations.
  • Legitimate Interest. We may disclose Personal Data about you in the following circumstances:

  • Group Entities. We may disclose Personal Data about you to our affiliates and subsidiaries.
  • Public Posts. Any information that you voluntarily choose to post to a publicly accessible area of our Services, or via social media will be available to anyone who has access to that content.
  • Service Providers. We work with third-party service providers to provide services such as hosting, payment processing, maintenance, and support. These third parties may have access to or process your Personal Data as part of providing those services to us.
  • Legal.   • Aggregated Information. We may use and disclose aggregated or otherwise de-identified information for any purpose, unless we are prohibited from doing so under applicable law.

5. Your EU Resident Rights and Choices

Unless otherwise provided under applicable law, you have the following rights:

  • Access and Portability. You may ask us to provide you with a copy of the Personal Data we maintain about you, including a machine-readable copy of the Personal Data that you have directly provided to us, and request information about its processing.
  • Rectification and Deletion. You may ask us to update and correct inaccuracies in your Personal Data, or to have the information anonymized or deleted, as appropriate.
  • Restriction and Objection. You may ask us to restrict the processing of your Personal Data, or object to such processing.
  • Consent Withdrawal. You may withdraw any consent you previously provided to us regarding the processing of your Personal Data, at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdrew your consent.
  • Complaint. You may lodge a complaint with a supervisory authority, including in your country of residence, place of work, or where an incident took place.

Note that there are exceptions and limitations to each of these rights, and that we may nevertheless retain Personal Data about you where we reasonably believe that we have a legitimate reason to do so.

6. International Data Transfers

The Services are hosted in the United States. In order to communicate with you about content, the information that we collect from you may be transferred to, stored, used, and processed by PCI in the United States or one of our service providers based in the United States or outside of Europe and, in particular, to USA and other non-European countries, where the level of protection of Personal Data may be different than in your country. If we do so, we will comply with applicable data protection laws, in particular by relying on an EU Commission adequacy decision, rely on contractual protections for the transfer of your Personal Data, on Binding Corporate Rules or on the EU-U.S. Privacy Shield framework. 7. Data Security and Data Retention for EU Residents

We use physical, managerial, and technical safeguards that are designed to improve the integrity and security of Personal Data that we collect, maintain and otherwise process. We take measures to delete your Personal Data or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we are required by law to keep it for a longer period. When determining the retention period, we take into account various criteria, such as the type of products or services provided to you, the nature and length of our relationship with you, mandatory retention periods and the statute of limitations.

8. Third-Party Services for EU Residents

Our Services may contain features or links to websites and services provided by third parties. Any information you provide via these websites or services is provided directly to these third-party operators and is subject to their privacy policies, even if accessed through our Services. We encourage you to learn about these third parties’ policies before providing them with your Personal Data.

9. Changes and Updates to this Policy

We may update this Policy from time to time to reflect changes in our privacy practices. If we modify this Policy, we will indicate the date of the latest revision above.

Verification. We cannot respond to your request or provide you with personal information unless we can verify your identity and your authority to make the request and confirm that the personal information relates to you. A verifiable consumer privacy request must:

  • provide sufficient information that allows us to reasonably verify you are the person about whom we have collected personal information or an authorized representative;
  • describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Authorized Agent. If you are a resident of California you may, under certain circumstances, authorize another individual or a business, called an Authorized Agent, to make requests on your behalf. If you wish to have an Authorized Agent make a verifiable consumer request on your behalf, they will need to provide us with sufficient written proof that you have designated them as your Authorized Agent, and we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information.

Responding to Your Request. It is our goal to respond to your request within 45 days of receiving that request. If we require more time or unable to comply with your request, we will inform you of the reason and inform you of the extension period for completion in writing. Any disclosures we provide will only cover the 12-month period preceding receipt of the verifiable consumer request. If we cannot comply with part or all of your request, we will explain the reasons in our response.

We do not charge a fee to process or respond to your verifiable consumer privacy request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Appeals. Residents of California, Texas, and Virginia have the right to appeal a denial of their request by contacting us as described in our notice of denial.

California “Shine the Light” Law

If a business shares “personal information” (as defined in California’s “Shine the Light” law, Cal. Civ. Code § 1798.83) with third parties for their direct marketing purposes (e.g., to send offers and information that may be of interest to you), California law requires either providing a mechanism by which consumers can obtain more information about such sharing over the prior calendar year, or providing a mechanism by which consumers can opt out of such sharing. We do not share your personal information with third parties for their direct marketing purposes.

Nevada Disclosure
